Terms of Service

These Terms of Service ("Terms") govern your access to and use of Sakura, including the Sakura app, website, and related services (collectively, the "Service").

By accessing or using Sakura, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be legally capable of entering into a binding agreement to use Sakura.

If you use blockchain, payment, swap, or perpetuals features, you represent that:

• you are legally allowed to use those features in your jurisdiction
• you understand the risks of blockchain transactions and digital assets
• you are responsible for compliance with laws and regulations that apply to you

2. Description of the Service

Sakura provides a wallet-connected entertainment and creator platform that may include:

• manga, anime, and novel browsing and reading
• creator profiles and creator submissions
• comments, reactions, profiles, and community features
• token-based premium/pass features
• creator tipping and token-paid highlights
• token swaps, fiat on-ramp integrations, and optional perpetuals trading features
• local and onchain sync for user preferences and progress

Some features may be added, removed, restricted, or changed at any time.

3. Wallet Responsibility

Sakura may allow you to connect or create a Solana wallet.

You are solely responsible for:

• your wallet
• your private key, secret key, seed phrase, backups, and biometric/device security
• every transaction you approve, sign, submit, or authorize
• any loss resulting from device compromise, phishing, mistaken transfers, signing the wrong transaction, or loss of wallet credentials

Transactions on blockchains are generally irreversible. Sakura is not responsible for reversing or recovering completed blockchain transactions.

4. No Financial Advice

Sakura is not a broker, investment adviser, financial adviser, bank, money transmitter, or fiduciary.

Nothing in Sakura constitutes:

• financial advice
• investment advice
• legal advice
• tax advice
• a recommendation to buy, sell, hold, or trade any token or asset

You are solely responsible for evaluating any transaction, trade, swap, or payment you make.

5. Trading, Token, and Blockchain Risk

By using Sakura's blockchain-related features, you acknowledge and accept that:

• digital assets are volatile and may lose value
• token prices can change rapidly
• perpetuals trading may involve leverage, liquidation, funding payments, slippage, smart contract risk, oracle risk, and total loss
• network congestion, failed transactions, protocol outages, and third-party service interruptions may occur
• on-ramp, swap, and protocol integrations are provided through third parties and may have additional terms, fees, restrictions, or KYC requirements

Sakura does not guarantee execution quality, uninterrupted access, profitability, or the continued availability of any token, pass, swap, or trading feature.

6. Third-Party Services

Sakura may integrate third-party services and protocols, including infrastructure, content providers, wallet tools, payment providers, swap routers, and trading protocols.

Examples may include:

• Solana network infrastructure
• Supabase
• Transak
• Jupiter
• Drift Protocol

We do not control third-party services and are not responsible for their content, availability, security, performance, policies, or acts and omissions. Your use of those services may be subject to their own terms and privacy policies.

7. Content and Intellectual Property

Sakura may display or link to third-party manga, anime, novel, or metadata content. Such content may belong to third parties.

Sakura does not claim ownership of third-party intellectual property displayed through the Service. All trademarks, logos, artwork, and content belong to their respective owners.

8. User Content

You may submit content such as:

• comments
• profile information
• creator submissions
• novel content
• bios, titles, descriptions, and related text

You retain ownership of content you lawfully own, but by submitting content to Sakura, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, moderate, and otherwise use that content as necessary to operate, improve, and promote the Service.

You represent that:

• you have the rights needed to submit the content
• your content does not infringe third-party rights
• your content is not unlawful, abusive, fraudulent, misleading, malicious, or otherwise prohibited

9. Prohibited Conduct

You agree not to:

• violate any law or regulation
• infringe intellectual property or privacy rights
• use Sakura to harass, abuse, threaten, or defraud others
• post unlawful, defamatory, obscene, hateful, or abusive content
• upload malware, exploit vulnerabilities, or interfere with security
• scrape, overload, disrupt, or attack the Service or its infrastructure
• impersonate any person or misrepresent affiliation
• circumvent access restrictions, payment systems, or entitlement checks
• use Sakura in a way that exposes us or others to legal or regulatory risk

10. Premium Access, Tips, and Token-Based Features

Sakura may offer paid or token-gated features, including premium access, creator tipping, highlighted comments, and similar functionality.

You understand and agree that:

• token prices and fees may change
• eligibility rules for premium/pass features may change
• blockchain payments are generally irreversible
• entitlement checks may rely on wallet ownership, public on-chain data, and app-side or backend verification
• access to token-based features may be suspended or changed for operational, technical, legal, or security reasons

11. Suspension and Termination

We may suspend, restrict, or terminate your access to Sakura, with or without notice, if:

• you violate these Terms
• we suspect fraud, abuse, security issues, or unlawful activity
• required by law, regulation, court order, or third-party provider requirement
• necessary to protect the Service, users, creators, or Sakura

We may also discontinue any part of the Service at any time.

12. Availability and No Warranty

Sakura is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Sakura disclaims all warranties, express or implied, including warranties of:

• merchantability
• fitness for a particular purpose
• non-infringement
• availability
• accuracy
• reliability
• uninterrupted operation
• error-free performance

We do not guarantee that Sakura or any third-party integration will always be available, secure, or free from bugs, delays, or failures.

13. Limitation of Liability

To the maximum extent permitted by law, Sakura and its operators, affiliates, service providers, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, digital assets, or business opportunities arising out of or related to your use of the Service.

To the maximum extent permitted by law, Sakura's total liability for any claim relating to the Service will not exceed the greater of:

• the amount you paid to Sakura, if any, in the 12 months before the claim, or
• USD $100

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Sakura, its operators, affiliates, service providers, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use of the Service
• your wallet activity
• your content
• your violation of these Terms
• your violation of any law or third-party rights

15. Changes to the Service or Terms

We may update Sakura or these Terms at any time. If we update these Terms, we will update the "Last updated" date above. Continued use of Sakura after changes become effective means you accept the updated Terms.

16. Governing Law

These Terms are governed by applicable law, without regard to conflict of laws principles, except where applicable law requires otherwise.
